Early estate planning: 4 reasons why peace of mind could be the greatest gift to your family

Category: News

It’s easy to push estate planning to the bottom of your financial to-do list while balancing the daily demands of family, career, and personal goals. However, putting a clear estate plan in place early is not an administrative task to leave for retirement.

Moreover, early estate planning could help protect the wealth you have worked hard to build and provide reassurance for your loved ones when they need it most.

Waiting until a sudden health scare or major life change forces your hand could leave your family facing legal delays, administrative hurdles, and potential tax liabilities that could otherwise have been avoided.

Keep reading to discover four compelling reasons why estate planning should be at the top of your priority list.

1. You can organise your financial affairs and simplify your legacy

Decades of building wealth could leave you with scattered pensions, multiple bank accounts, old life insurance policies, and outdated property valuations. Creating an early estate plan gives you the opportunity to audit your portfolio and assets and collate them into a single, organised record that makes the administration of your estate simple for your executors.

Reviewing these arrangements every few years, or when a major milestone such as marriage, divorce, or a birth occurs, means you can adapt your estate plan alongside your changing family dynamics.

2. You can protect your loved ones from the uncertainty of intestacy

Dying intestate, or without a valid will, means that your assets will be distributed according to intestacy rules. In England and Wales, if you die without a spouse or civil partner, inheritance passes down in the following order:

  • Children or their descendants
  • Parents
  • Full siblings or their descendants
  • Half-siblings or their descendants
  • Grandparents
  • Full aunts and uncles or their descendants
  • Half-aunts and half-uncles or their descendants

Please note that intestacy rules differ in Scotland and Northern Ireland.

If there are no entitled relatives, the estate generally passes to the Crown or, where applicable, the Duchy of Lancaster or Cornwall.

As you can see, dying intestate means that your assets may not be distributed according to your wishes and some of your intended beneficiaries could be overlooked. For example, unmarried partners and stepchildren are unaccounted for, which could leave these loved ones in a vulnerable position.

An up-to-date will, combined with clear expression of wish forms for your pensions and life insurance policies, ensures your assets and benefits pass in accordance with your wishes.

3. You gain vital time to make tax-efficient gifts to reduce your estate

Many Inheritance Tax (IHT) mitigation strategies make use of allowances that cannot be carried forward indefinitely, and the earlier you start, the more flexibility you have.

As of the 2026/27 tax year, these are some of the IHT allowances and exemptions that may be available to you.

  • Nil-rate band: The amount of your estate you can pass on to your beneficiaries tax-free, set at £325,000 per individual. Any unused nil-rate bands can be transferred to a surviving spouse or civil partner, up to £650,000.
  • Residence nil-rate band: Up to £175,000 when passing a main residence to a direct descendant, increasing to £350,000 depending on the availability of spousal allowances. Keep in mind that this tapers off when estates are worth more than £2 million.
  • Spousal exemptions: 100% tax-free transfers between married couples or civil par
  • Annual gifting exemption: £3,000 tax-free each year, with a one-year carry-forward rule for any unused part of your allowance.
  • Gifts out of normal, surplus income: Unlimited tax-free gifts, provided they are made from regular income, form part of your normal expenditure, and do not compromise your standard of living.
  • Small gifts exemption: Tax-free gifts of up to £250 per person per tax year to as many individuals as you wish, provided you haven’t used another exemption for the same recipient.

Early estate planning allows you to coordinate lifetime gifting strategies over several years. For instance, most outright financial gifts to individuals fall outside of your estate for IHT purposes if you survive for seven full years after making them.

If you pass away between three and seven years after making gifts that exceed your available nil-rate band, taper relief may reduce the tax payable on those gifts. The more time that passes, the lower the tax burden could be.

In 2026/27, the tapering rate for IHT is:

  • Less than three years – 40% IHT rate
  • Three to four years – 32% IHT rate
  • Four to five years – 24% IHT rate
  • Five to six years – 16% IHT rate
  • Six to seven years – 8% IHT rate

As you can see, the more time you allow in your estate plan, the wider your options could be and the more likely your family is to retain as much wealth as possible.

4. Your healthcare and financial decisions remain in the hands of people you trust

Estate planning includes “living controls” that aim to protect your interests while you’re still alive. By establishing Lasting Powers of Attorney (LPAs) for property and financial affairs as well as health and welfare, you can appoint trusted individuals to make decisions on your behalf.

Planning for loss of capacity is important, particularly when you consider dementia and Alzheimer’s statistics in the UK.

Mental and physical incapacity can strike without warning, and the number of people living in the UK with a disability are staggering. According to the Alzheimer’s Society (10 May 2024), more than 900,000 people in the UK live with dementia. It also states that 1.4 million people may be living with dementia by 2040.

Putting an LPA in place while you’re healthy and aware ensures that your care and financial management remain in trusted hands.

Without an LPA, your family would need to make a costly and time-consuming application to the Court of Protection to gain legal authority to support you.

Note: A registered property and financial affairs LPA can be used with your permission while you retain capacity, whereas a health and welfare LPA only becomes usable if you lose the capacity to make the relevant decisions.

Remember that taper relief only applies to gifts in excess of the nil-rate band. It follows that, if no tax is payable on the transfer because it does not exceed the nil-rate band (after cumulation), there can be no relief.

Taper relief does not reduce the value transferred; it reduces the tax payable as a consequence of that transfer.
